It won't be grayed out unless you do it with multiple high level accounts or 1 expert or mod

Normal users can but like what's been stated, it won't turn gray.

Normal users don't have the same "offensive mark-strength" as mods, not enough to get it grayed out.

(Getting it grey can also happen if a load of users work together. Or if people with high status are doing it. Probably using multiple accounts as well. >>)
